*This authority is to remain in effect and the account will continue to be billed monthly until SBTC receives a written and signed cancellation notice delivered either in person or via certified US mail along with a copy of a state issued photo I.D*

1. The enrollment fee, membership fee and VIP packages are NOT refundable or transferable.
2. All fees are paid in advance and will be debited without notice by SBTC on the 1st of each month.
3. South Beach Tanning Company reserves the right to cancel memberships at any time.
4. All prices, fees and draft dates are subject to change without notice. Federal and state taxes will be charged when required by law.
5. SBTC reserves the right to assign this authorization to a 3rd party without notice.
6. Accounts with delinquent balances for 3 consecutive months will be subject to collections.
7. SBTC subscribes to the MC/VISA Billing Updater Service by which changes to credit card numbers and expiration dates are updated automatically within our system directly by MC/VISA.
8. A $5.00 decline fee will be charged on all declined transaction & will be drafted automatically.
9. All VIP memberships are automatically renewed on the 1st of each month.
10. For all accounts signed up on a promotional offer there is a 3 month minimum. Cancellations, freezes, or downgrades cannot be made until after the 3rd successful monthly payment. For cancellations submitted prior to the date of the 3rd membership payment, all remaining balances on the account up to and including the 3rd payment must be paid in order for the cancellation to be processed.
11. Accounts may be frozen for up to 3 months per calendar year at a charge of $5.00 per month. 30-day notice is required to freeze accounts for the next bill cycle.
12. Memberships purchased with a promocode must go through 1 full billing cycle before downgrading.
13. A service fee of 1 ½% per month or 18% APR will be added to overdue accounts. All reasonable costs of collections and attorney fees will be added to accounts subject to collections.
14. All cancellation forms must be received at least 30 days prior to the scheduled billing date otherwise one final debit will be made as scheduled. (Example: To cancel your membership as of July 1st, you must complete a cancellation request by June 1st). Delinquent accounts cannot be cancelled until all past due balances are paid in full.

CONTACT WITH MEMBERS. Member affirms, acknowledges and attests that Member’s mailing address, telephone number, and e-mail address provided on the face of this agreement, or subsequently provided by the member to South Beach Tanning Company (SBTC), are accurate and were provided by Member voluntarily. SBTC, including its agents and affiliates may contact you via telephone, robocalls, email, text message or other means from time to time for the purpose of notifying you of issues related to your membership or billing information, for automatic payment processing issues or for messages deemed to be advertisements. By providing us with your contact information and signing this agreement, you give your prior express written consent to receive membership and billing-related communications, and messages deemed to be advertisements from us or our authorized delegate to the extent permitted by applicable law, including without limitation the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act. By providing us with your contact information and signing this agreement, you give your prior express written consent to receive SMS text messages from SBTC, including its agents and affiliates, even if such communications are considered advertisements and even if such communications are received after the termination of this agreement.  This provision survives the termination of this agreement.  Text alerts may be sent using an automated dialing system. Your consent to receive text messages is not a condition of purchasing any goods or services, nor is it a condition to maintain this contract in good standing. Members can opt-out of SMS communications by replying “STOP” to any SMS text communication you receive. Message and data rates may apply.
